Governor Rod Blagojevich’s Senate impeachment trial is moving forward with or without the Governor’s involvement, according to Senator Tim Bivins.

The Governor failed to meet a January 21 deadline to tell the Senate what witnesses and what documents he would like to subpoena for the trial, which is expected to start January 26. As such, the presumption is that the Governor pleads “not guilty.”

The Governor also failed to respond to the formal charge that he abused his power as Governor, and on January 20 also failed to meet a deadline to dismiss the charges against him. If the Governor had requested the charges be dropped, the Senate – acting as the trial judges – would have voted on his request.
